Terms of Service

These Terms of Service (“Terms”) govern your use of TrackVis at trackvis.app and related services (the “Service”), operated by TrackVis (“we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. The Service

TrackVis is a browser-based tool for creating music visualizer videos. You upload your own image and audio, customize the layout, and export MP4 files for social platforms. Preview and editing are available without export; MP4 export may require sign-in and a paid plan or trial allocation as described at checkout.

2. Your content

You retain all rights to images, audio, text, logos, and videos you upload or create. You represent that you have the rights to use that content and that it does not infringe others’ rights or violate applicable law.

You grant us a limited license to process your uploads only as needed to provide the Service (for example, temporary server-side encoding during MP4 export). We do not claim ownership of your creative work.

3. Accounts

You must provide a valid email address. You are responsible for activity on your account. You may delete your account at any time from the Account page; see our Privacy Policy for what data is removed.

4. Subscriptions and purchases

Paid plans and export packs are billed through Stripe. Prices and export limits are shown before checkout. Subscriptions renew automatically until canceled via the Stripe customer portal or Account page. One-time export packs add credits for the current billing period only unless otherwise stated.

From time to time we may offer promotional or discounted pricing on a subscription (for example, a reduced rate for an introductory period via a promo code). Unless stated otherwise when the offer is presented, discounted pricing applies only for the stated introductory period; your subscription then automatically renews at the plan's regular list price shown on our Pricing page, and you will be charged that price unless you cancel beforehand.

5. Acceptable use

You agree not to:

• Use the Service for unlawful content or to infringe intellectual property
• Attempt to bypass export limits, authentication, or security controls
• Overload or disrupt the Service (including automated abuse of export APIs)
• Reverse engineer or resell the Service except as permitted by law

We may suspend or terminate access for violations or to protect the Service.

6. Availability and changes

The Service is provided on an “as is” and “as available” basis. We may modify features, pricing, or these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.

7. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted export, specific file sizes, or platform acceptance by Instagram, TikTok, or other third parties.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) USD $50.

9. Indemnity

You will indemnify and hold us harmless from claims arising from your content, your use of the Service, or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Oregon, unless applicable law requires otherwise.
